What Constitutes Sexual Orientation and Gender Identity Discrimination in the Workplace?

There are a number of ways someone may be targeted in the workplace for their sexual orientation, gender identity, or gender expression. For example, refusal to hire, wrongful termination, and unequal salary, conditions, or privileges in the workplace all constitute unlawful discrimination. Some other examples of sexual orientation or gender identity discrimination in the workplace include, but are not limited to, the following:

  • Being harassed by an employer or coworker based on your sexual orientation, gender identity, or gender expression;
  • Being denied a promotion based on your sexual orientation, gender identity, or gender expression;
  • Being denied work benefits, including things such as insurance, due to your sexual orientation, gender identity, or gender expression;
  • Being the target of or hearing derogatory or insulting comments regarding homosexual, bisexual, or transgender individuals;
  • Being targetted or treated differently and/or unfairly by your boss, supervisor, or manager, especially after they learn of your sexual orientation or transgender status.

According to a study conducted by The Williams Institute, a research institute founded at the UCLA School of Law dedicated to sexual orientation and gender identity law and public policy, between 15 to 43 percent of gay and transgender workers claim to have experienced some form of discrimination while on the job. Further, nearly 17 percent of these workers have reported being terminated, with many of them having received verbal or physical abuse due to their sexual orientation or transgender status.

The short answer is: Not in New Jersey! New Jersey’s Law Against Discrimination was amended in 1991 to include “affectional or sexual orientation and in 2006 to include “gender identity and expression” as prohibited categories of discrimination.
