New Jersey Sexual Orientation & Gender Identity Discrimination Lawyer
Protecting Against Sexual Orientation and Gender Discrimination in the Workplace
Homophobia and Transphobia in the Workplace
According to a study conducted by The Williams Institute, a research institute founded at the UCLA School of Law dedicated to sexual orientation and gender identity law and public policy, between 15 to 43 percent of gay and transgender workers claim to have experienced some form of discrimination while on the job. Further, nearly 17 percent of these workers have reported being terminated, with many of them having received verbal or physical abuse due to their sexual orientation or transgender status.
Can You Be Fired for Being Gay or Transgender?
The simple answer to this question is “No.” New Jersey’s Law Against Discrimination was amended in 1991 to include “affectional or sexual orientation and in 2006 to include “gender identity and expression” as prohibited categories of discrimination.
Nonetheless, even though New Jersey’s Law Against Discrimination makes it illegal for employers to discriminate against employees due to their sexual orientation or gender identity, discrimination in the workplace on account of these issues remains a very prevalent problem in this state. At Schall & Barasch LLC, we have years of experience handling such matters and can help those who have been wrongfully discriminated against on account of their sexual orientation or their gender identity. If you feel you have been discriminated against for your sexual orientation or gender identity, we want to help.
Your Right to Be Free from Sexual Orientation and Gender Identity Discrimination in the Workplace
You have the right not to be targeted in your workplace and not to be subjected to a hostile work environment on account of your sexual orientation, gender identity, or gender expression. It is clearly unlawful for an employer not to hire you, or to fire you, on account of your sexual orientation, gender identity, or gender expression.
Some other examples of sexual orientation or gender identity discrimination in the workplace include the following:
- Being harassed by a supervisor or coworker based on your sexual orientation, gender identity, or gender expression.
- Being denied a promotion based on your sexual orientation, gender identity, or gender expression.
- Being denied work benefits, including things such as insurance, due to your sexual orientation, gender identity, or gender expression.
- Being the target of, or overhearing, derogatory or insulting comments regarding homosexual, bisexual, or transgender individuals.
- Being targeted or treated differently and/or unfairly by your boss, supervisor, or manager, especially after they learn of your sexual orientation or transgender status.
